- MLP limits its intervention to collecting records from Partners, serving as a mediator between Tutors and Partners. In this way, facilitating the process of choosing a Partner;
- The Tutor may choose not to select any of the Partners, who contact him to present their respective services, recognizing that MLP is a third party in the contractually established relationship between Tutor and Partner and cannot guarantee compliance with the provision by the Partner or any transaction that may be agreed between them;
- To make a reservation you must create an Account. Please ensure that all your information (including payment details and contact details) is correct and up to date, or you may not be able to access your experience(s). Partners agree to contact the Tutors if such care is necessary or, if the Tutors are not available, to contact MLP via telephone or email support@mylittlepet.pt. Guardians authorize the Partner and MLP to obtain and authorize veterinary care for the Animal if they cannot be contacted to authorize care in an emergency. - any supporting documents (bank statement, images, receipts, etc.).
- All queries and complaints are registered and the most urgent are treated with priority.
- If you are a resident of the European Economic Area (EEA) and you are not satisfied with the way we are handling your complaint, you can lodge a complaint on the European Commission's Online Dispute Resolution (RLL) platform (ec.europa.eu/ The Doctor). Depending on the subject of the complaint:
- whether it's about accommodation, a flight or an attraction, you can use this RLL platform.
- if it is about land transport you cannot use it (because the land transport will have been booked in “dictionary” and the UK has already left the EU).
- We attempt to resolve disputes internally and are not required to submit to any alternative dispute resolution procedures carried out by independent providers.
Communication with the Partner
We can help you communicate with the Partner, but we cannot guarantee that the Partner will read any information you provide or will do what you request.
Measures against inappropriate behavior
We have the right to prevent and/or cancel reservations you have made and/or interrupt your use of our Platform, customer service, and/or your account. We will only do so if we consider there is a reason for doing so – for example:
- fraud or abuse
- non-compliance with
- Our values or applicable laws or regulations
- Inappropriate or unlawful behavior (e.g. violence, threats or invasion of privacy) towards us, any of the companies we work with – or anyone else, for that matter.
If we cancel a booking as a result of this behavior, you will not be entitled to a refund. We may provide you with a reason for canceling your reservation, unless this (a) violates applicable laws and/or (b) prevents or obstructs the detection or prevention of fraud or other illegal activities. If you believe that we have incorrectly canceled your booking, please contact our Customer Service team.
20. Applicable Law and Venue
- To the extent permitted by mandatory (consumer) law in force locally, these Terms and our services will be governed by Portuguese law (for Experiences);
- To the extent permitted by mandatory (consumer) law in force locally, any dispute will be exclusively submitted to the competent courts in Portugal (Experiences);
- This User Agreement is governed and interpreted in accordance with Portuguese law. The Lisbon District Court, to the exclusion of any other, is competent to resolve any conflicts arising from the interpretation and application of this User Agreement for the use of the MLP;
21. Penalties
- MLP reserves the right to investigate and evaluate complaints that it deems necessary, in order to decide whether to keep Tutors and Partners on its platform;
- The use of the platform may be temporarily suspended if a violation of the obligations of Tutors and/or Partners as established in this agreement is verified or suspected;
- Users may be permanently banned from accessing the website if they seriously violate the terms of this User Agreement, considering the severity of the behavior, means used, damage caused or persistence in violations after warnings;
- MLP reserves the right to suspend or terminate services provided to a Tutor or Partner if a violation of this User Agreement or applicable legislation is suspected.
22. Compensation
The User agrees to exempt, defend (at MLP's discretion), indemnify and discharge MLP, its branches and subsidiaries (where applicable), as well as their employees, managers and agents, from any liability and obligation arising from or related to: ( i) violation of these Terms or MLP Policies; (ii) misuse of the MLP Platform or Services; (iii) interactions with other Users or inappropriate use of any service on the platform, including damages resulting from such interactions or use; (iv) collection and remittance of service fees by MLP; or (v) violation of laws, regulations or rights of third parties. This release covers all claims for compensation, damages, losses and expenses, including court fees and legal fees.
23. Prices and Payments
- When you make a reservation, you agree to pay the cost of the experience, including any fees and taxes that may apply;
- Some of the prices you see have been rounded to the nearest whole number. The price you will pay is based on the original, “unrounded” price (although the actual difference will be small);
- Obvious errors and typographical mistakes are not binding. For example: if you book transport or a hotel night that was mistakenly offered at €1, we can simply cancel that booking and refund any amount you have paid;
- The price of the service is defined by the Partner and can never be less than €5;
- The Price of the commission fee or contract charged by MLP to the Partner is defined by MLP and can be updated at any time. We will try to inform Partners in advance whenever there are price updates;
- Prices for Tutors: Tutors can purchase the services made available by MLP through the Platform by filling out a Reservation. The Guardian of an MLP Animal initiates a transaction with MLP when accepting a reservation and agreeing to pay the total costs indicated therein. The prices for the services are determined by the Partners themselves. The total amount payable for the service may include a service fee payable to the MLP. When required by law, the amount charged may also include taxes at the applicable rate. The Partner, not MLP, is responsible for performing the service;
- Payment is made in three stages in the Commissions modality:
- The Tutor makes the reservation by paying the respective amount to MLP, MLP issues a direct invoice for the total amount to the Tutor via automatic email;
- The Partner will only receive the amount due after issuing an invoice to MLP for the total value of the service. The amount payable to the Partner is deducted from the MLP commission rate;
- The value of the service fee that is paid directly to suppliers at the same time that the MLP Partner Payment occurs.
- Payment is made at a time using the Avença payment method (temporarily unavailable):
- The Tutor makes the reservation by paying the respective amount to MLP, MLP issues a direct invoice for the total amount to the Tutor via automatic email;
- The Partner will receive the amount due immediately in the total value of the service by MLP. The amount payable to the Partner is in full, as the Agreement is paid only once a month by the Partner and its invoice is issued by MLP at the time it pays for its acquisition/renewal.
- The Partner is responsible for issuing an invoice to the Tutor for the service provided.
- Partners agree to provide a service to a Tutor, according to the conditions described in the Booking. Tutors must confirm the Booking before it expires. Once the Booking is completed and accepted by both parties, the Partner will be bound by the price established in the booking. The purchase of a service on MLP is characterized as a transaction between MLP, the Tutor, and the Partner. Payment for the service to the Partner must be made upon booking by the Tutor, defining their payment terms. The amount to be received by the Partner must correspond to the total amount sent to the Tutor, minus the MLP fees (if applicable).
- Service Fees: Service fees may be charged for some aspects of the MLP or Partner service;
- A service fee is added to the Tutor to the amount defined by the MLP or Partner;
- The Partner is deducted the service fee from the amount payable by the Tutor;
- Late fees and additional charges: The Guardian acknowledges and agrees that if you do not collect your Animal at the end of the service period agreed upon in the reservation, you will be charged for additional service time, for each day of delay in accordance with the established daily rate. You also agree to indemnify MLP, and agree that MLP may charge your credit card or other payment method for any additional costs and expenses incurred by MLP or the Partner. This, as a result of your failure to retrieve the Animal at the end of the service period agreed upon in the booking;
- The sale of animals on this platform is prohibited. If any user (Partner, Tutor or others) attempts to make a sale of this nature, they will be suspended or removed from the platform;
- Cancellations and Refunds
Reservations are controlled by Partners who decide whether reservation fees and refunds will apply. MLP will only serve as an intermediary in the transaction. Except when agreed and paid directly to the Partner. Here, MLP has no responsibility:
- Cancellations by Partner:
- If the Partner cancels a booking before or during the service period identified in the booking, and MLP has already made payment to the Partner (for which the Partner has already invoiced MLP), MLP will not refund the amount paid by the Tutor to MLP; The Partner is responsible for reimbursing the Tutor;
- If the Partner cancels a reservation before the service period identified in the reservation, and MLP has not yet made payment to the Partner (nor has the Partner invoiced MLP), MLP will reimburse the customer via bank transfer for the net amount of the service fee ;
- If the Tutor has paid for any part of the service directly to the Partner, MLP is not responsible for returning the amount paid. The return will be the sole responsibility of the Partner.
Cancellation by the Partner may result in a review of your account and, if MLP deems it appropriate, may suspend or terminate your access to the platform and even the non-refund of fees;
- Cancellations by Tutors:
- Tutor as beneficiary: If the Tutor cancels the reservation, he or she is subject to complying with the Partner's terms and conditions, set out on the platform at the time of the reservation;
- If the Tutor cancels a booking before or during the service period identified in the booking, and MLP has already made payment to the Partner (whose invoice the Partner has already issued to MLP), MLP will not refund the amount paid by the Tutor to MLP; The Partner is responsible for reimbursing the Tutor;
- If the Tutor cancels a booking before the service period identified in the booking, and MLP has not yet made payment to the Partner (nor has the Partner invoiced MLP), MLP will reimburse the customer via bank transfer for the net amount of the service fee ;
- If the Tutor has paid for any part of the service directly to the Partner, MLP is not responsible for returning the amount paid. The return will be the sole responsibility of the Partner.
- Payment disputes: Payment outside the MLP service: MLP only receives the reservation amount corresponding to its service. The value of the Partner's service must be paid by the Tutor directly to the Partner in accordance with its payment policy on our platform. Any payment disputes are between the Tutor and the Partner, and MLP has no obligation to mediate but may facilitate resolution and may apply refunds or apply fees relating to the cost of this resolution. MLP is not responsible for any payments made outside the MLP platform;
- TaxesThe User is responsible for paying any taxes that arise as a result of their purchase, provision, or use of services through MLP. This includes, without limitation, any form of tax at the applicable legal rate on sales or services rendered on amounts paid or received through MLP.
- If we arrange your payment, we will be responsible for managing your payment and ensuring the completion of your transaction with our Partner. In this case, your payment constitutes the final settlement of the price “due and payable”;
- If the Partner has a monthly agreement with our platform, MLP will issue an immediate receipt-invoice, when the Partner is selected on this modality's website. In this case, there is no need for the Partner to pay commissions to MLP on the service provided. Only the stipulated payment amount;
- There is no room for payments that are not made in EURO currency;
- We may store your payment method details for future transactions after receiving your consent.
- Campaigns, Promotions and Coupons
MLP may launch campaigns, promotions, or coupons directly on the platform. All Partners will be automatically bound by these actions, without the possibility of contesting or requesting compensation or indemnification. When an offer is made, it applies to everyone — as stipulated by MLP's policy.
Example:
Promotion: €5 discount per item purchased (including both basic and extra services).
If the standard service and the extra service both cost €5, and the customer books for two animals, the total amount to be paid will be €5 (VAT included).
